WORK PERMIT FOR A FOREIGNER
WORK PERMIT

Type E work permit
it is needed to employ a foreigner who will be posted to the territory of the Republic of Poland by a foreign employer for a period of more than 30 days within the next 6 months for a purpose other than described above.
Extension permit
It is worth knowing that the employer may apply for an extension of any type of work permit not earlier than 90 days and not later than 30 days before the expiry of the permit.
EMPLOYMENT OF A FOREIGNER STEP BY STEP

- a copy of the foreigner’s passport,
- a proof of administrative fee,

TEMPORARY RESIDENCE PERMIT FOR THE PURPOSE OF WORKING IN A PROFESSION REQUIRING HIGH QUALIFICATIONS (BLUE CARD)
We are a team of lawyers specializing in completing formalities related to the employment of foreigners in Poland. We mediate in obtaining temporary residence permits to work in a profession requiring high qualifications, the so-called Blue Card. DECLARATION ON ENTRUSTING WORK TO A FOREIGNER
We are a law firm from Warsaw specializing in arranging several documents necessary in the process of employing foreigners.
One of them is the declaration on entrusting work to a foreigner, which entitles the employer to employ the foreigner in the territory of the Republic of Poland for a maximum of 180 days within 12 months.
The declaration of entrustment applies only to citizens of Armenia, the Republic of Belarus, the Republic of Georgia, the Republic of Moldova, the Russian Federation and Ukraine.
WHAT DOCUMENTS ARE NEEDED TO OBTAIN A DECLARATION ON ENTRUSTING WORK TO A FOREIGNER?
To obtain the declaration, the employer should submit the following documents to the competent district labour office:
- a current copy of the foreigner’s passport,
- proof of payment of the administrative fee,
- declaration of no criminal record of the entity entrusting the performance of work.
After obtaining a declaration on entrusting work to a foreigner, the employer may employ such a person in accordance with the declaration, provided that the foreigner has a valid residence permit in Poland i.e., an appropriate visa, a temporary residence permit or a biometric passport.
APPLICATIONS SUBMITTED TO OFFICES
If the employer wants to extend the period of foreigner’s employment, he may apply to the voivodeship with an application for a work permit. (LINK). Based on the declaration, the foreigner may obtain a visa at the Polish consulate.

SEASONAL WORK PERMIT
SEASONAL WORK PERMIT – WHICH INDUSTRIES IT COVERS?

Such a permit allows the employer to employ the foreigner to do seasonal work in the territory of the Republic of Poland for a maximum 9 months in a calendar year.
Seasonal work permit affects only a foreigner, whose work is directly related to agriculture, forestry, hunting and fishing or accommodation and catering.
To achieve seasonal work permit, the employer must submit to the district labour office the following documents:
- an actual copy of foreigner’s passport,
- a proof of a fee payment,
- a declaration of no criminal record of the entity entrusting the performance of work.
After obtaining a seasonal work permit, the employer may employ a foreigner on the terms specified in the permit – if he or she has a valid residence permit in Poland, i.e., an appropriate visa, a temporary residence permit or a biometric passport. In addition, on the basis of this permit, a foreigner may obtain a visa at the Polish consulate, or a temporary residence permit due to the performance of seasonal work – after applying to the competent voivode.

TEMPORARY RESIDENCE PERMIT FOR THE PURPOSE OF EMPLOYMENT OF A FOREIGNER DELEGATED BY A FOREIGN EMPLOYER IN THE TERRITORY OF THE REPUBLIC OF POLAND
WHO SUBMITS THE APPLICATION FOR THE RESIDENCE PERMIT?

A temporary residence permit for the purpose of performing work under the intra-corporate transfer entitles the employer based in Poland to employ a foreigner whose permanent place of work is outside the territory of the European Union. Temporary residence permit for the purpose of performing work under the intra-corporate transfer – additional benefits

SHORT-TERM MOBILITY OF A MANAGER, SPECIALIST, OR TRAINEE AS PART OF AN INTRA-CORPORATE TRANSFER

Temporary residence permit within the short-term mobility allows the employer to employ a foreigner who has the residence card with annotation ‘ICT’ issued by another state of European Union for a period up to 90 days in the next 180 days on the territory of the Republic of Poland. HOW TO OBTAIN A TEMPORARY RESIDENCE PERMIT FOR AN EMPLOYEE AS PART OF LONG-TERM MOBILITY?
A temporary residence permit as part of long-term mobility entitles the employer to employ a foreigner on the territory of the Republic of Poland for the period and under the conditions specified in the decision. INVITATIONS
INVITATION AS A CONDITION FOR OBTAINING A VISA FOR A FOREIGNER
The invitation is a document entitling the employer or business partner to obtain for a foreigner, for example a family member of an employee, the document needed to obtain a visa on the territory of Poland. We provide assistance and legal services in the implementation of all formalities related to inviting a foreigner.
The invitation must be entered in the register of invitations kept by the voivode. A relevant application may be submitted by a legal person or an organizational unit without legal personality, based in the territory of the Republic of Poland.
The application for entry in the register of invitations should be accompanied by documents confirming:
- the possibility of covering the costs of the foreigner’s stay, including expenses related to accommodation, meals and return of the foreigner to the country of origin,
- place of residence on the territory of the Republic of Poland, indicated as the place of accommodation of the foreigner.
A foreigner, after being invited to Poland, may obtain a visa to enter the territory of the Republic of Poland. Please note that the so-called guest invitation does not entitle the foreigner to work in Poland.

WHO IS A FOREIGNER?
A foreigner is a person who does not have the citizenship of the country where he or she resides. His rights and obligations, including the required documentation, are regulated by the law of each state as well as international and EU law. For example, for citizens of the European Union, you should not only comply with national law but also with EU regulations.
The Act on Foreigners, art. 3 pkt 2 defines a foreigner as a person who does not have Polish citizenship. On the one hand, a foreigner may be a person who has the citizenship of a Member State of the European Union, but also one who does not. The first of them may stay on the territory of the Republic of Poland for up to three months upon presentation of a document confirming identity and citizenship – it may be an identity card or a passport.
CITIZENS FROM OUTSIDE THE EU
On the other hand, citizens of non-EU countries, wishing to cross the Polish border, should have not only a photo document confirming their identity (e.g., a passport), but additionally – if required – a visa, as well as financial resources necessary to cover the costs of living.
Citizens of non-EU countries are required to justify the purpose and conditions of their arrival to Poland, should have sufficient funds for their subsistence (the amount of these funds is regulated by the minister of internal affairs with the minister of foreign affairs), and must be covered by health insurance, which is valid for territory of the Republic of Poland.

- change the decision in terms of employer without the need to submit a new residence application,
- apply for a long-term resident’s EU residence permit on more favorable terms,

TEMPORARY RESIDENCE PERMIT FOR THE PURPOSE OF STUDYING
We provide legal advice to the foreigners who intend to study at universities in Poland. We would like to inform you what conditions must be met in order to obtain a temporary residence permit in Poland to start or continue education at university.
A temporary residence permit for the purpose of studying at a Polish university entitles the foreigner to stay in Poland for the period of:
- with the first permit – up to 15 months,
- with the next permit – the duration of the studies but not shorter than 3 months and not longer than 3 years.

In order to obtain a temporary residence permit due to circumstances requiring a short-term stay, the foreigner should attach to the application, first of all, documents confirming the specific circumstances that have arisen.
A foreigner, after obtaining a temporary residence permit due to circumstances requiring a short-term stay in the territory of Poland, is entitled to stay in Poland for the period necessary to achieve the purpose of the stay.
If the foreigner stays on the territory of the Republic of Poland on the basis of a temporary residence permit due to circumstances requiring a short-term stay, the decision on the obligation to return cannot be issued, and in most cases previously issued decisions in this regard are not enforceable until the expiry date of the permit. This means that, despite the prior issuance of the decision on the obligation to return, the foreigner may freely cross the Polish border throughout the entire period for which the permit was granted.
However, it should be remembered that a stay in Poland on the basis of this permit may not constitute the basis for the process of further legalization of stay, i.e., applying for a temporary residence permit due to a different purpose, a long-term EU residence permit or a permanent residence permit.

PERMANENT RESIDENCE

- holders of a valid Card of the Pole who present documents confirming their intention to settle in Poland permanently;
- children of a Polish citizen under his/her parental authority;
- persons who have been granted asylum on the territory of the Republic of Poland;
- victims of trafficking in human beings who present documents proving:
- residing in the territory of the Republic of Poland immediately before applying for a permanent residence permit for at least 1 year on the basis of a temporary residence permit for victims of human trafficking;
- cooperation with law enforcement authorities in criminal proceedings for the crime of human trafficking;
- fear of returning to the country of origin;
- persons residing in Poland on the basis of a permit for tolerated stay, who immediately before applying for a permanent residence permit have continuously resided in the territory of the Republic of Poland for at least 10 years on the basis of a permit for tolerated stay;
- persons residing in Poland on the basis of refugee status, subsidiary protection or humanitarian residence permit, who immediately before applying for a permanent residence permit have continuously resided in the territory of the Republic of Poland for at least 5 years on the basis of refugee status, subsidiary protection or humanitarian residence permit.
